Although witness testimony would not be reliable given the nighttime lighting conditions, the fact that he was not asked to participate is significant. Brady's truck and clothes were not preserved as evidence to check for gun powder. He was allowed to wash his clothes and to modify and paint his truck before it was viewed by the trial jurors...
